Additional Terms and Conditions for Webnames.ca web builder Kickstart

Amended Effective October 2005

BY REQUESTING WEBNAMES.CA'S WEB BUILDER KICKSTART SERVICES ("KICKSTART"), YOU ACKNOWLEDGE AND SIGNIFY THAT YOU HAVE READ, UNDERSTOOD, AND AGREED, WITHOUT LIMITATION OR QUALIFICATION, TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH AND REFERENCED BELOW. IF YOU DO NOT ACCEPT AND AGREE TO THOSE TERMS AND CONDITIONS, YOU MAY NOT REQUEST THE KICKSTART SERVICES.

Agreement: Kickstart is governed by the Webnames.ca Terms of Use and Services Agreement (available by clicking here), the Supplementary Terms and Conditions for web builder Services (available by clicking here), and these Additional Terms and Conditions. Kickstart is an "Additional Service" within the meaning of the Supplementary Terms and Conditions for web builder Services.

No Additional Fees: Kickstart is a free service for use with Webnames.ca's web builder Services.

Availability: Kickstart may be used only with a valid and subsisting Webnames.ca web builder account, including the 15-day free trial account.

Scope of Services: Kickstart is a starter program that assists in the creation of e-mail accounts and a working Customer Website using Webnames.ca's web builder Services, and provides a personal tutorial regarding the Customer Website. Kickstart is not a full website design service. Kickstart may be used only once by Customer.

Email Accounts: As part of Kickstart, Webnames.ca will create e-mail accounts for the number of accounts included in the applicable Webnames.ca web builder account (not available for trial accounts). Customer is responsible for providing required e-mail account names. All e-mail accounts will be set to a common password, which should be immediately changed by the applicable users.

Website: As part of Kickstart, Webnames.ca will spend up to 1 hour assisting in the creation of the Customer Website (to a maximum of 6 pages and 6 images), based upon the information provided by Customer in the Kickstart Application Form and the text and images provided by Customer. All text must be in Microsoft Word or .txt formats, with the text for each website page beginning on a new page and clearly identified. If text is not provided for a website page, Webnames.ca will insert placeholder text. All images must be provided in jpeg, gif or compressed tif format. Webnames.ca may optimize images for use on the Customer Website. If Customer already has a website, Webnames.ca will transfer the website (to a maximum of 6 pages) to the Webnames.ca web builder system, subject to changes required by the Webnames.ca web builder system. Webnames.ca will create the Customer Website based upon the information contained in the Kickstart Application Form, but may use its discretion regarding the layout and design of the website. CUSTOMER IS SOLELY RESPONSIBLE FOR, AND BEARS ALL RISKS AND LIABILITIES ASSOCIATED WITH, THE CUSTOMER WEBSITE AND ITS CONTENT.

Personal Tutorial: As part of Kickstart, Webnames.ca will provide Customer with a 15 minute personal tutorial, reviewing the Customer Website and providing information regarding further development of the Customer Website.

Ownership: All logos, designs and other elements of the Customer Website created or provided by Webnames.ca as part of Kickstart (collectively, the "Kickstart Elements") are part of the Webnames.ca web builder Services owned by Webnames.ca and its licensors. Customer may use the Kickstart Elements only as part of the Customer Website and subject to the Supplementary Terms and Conditions for web builder Services. Any other uses of the Kickstart Elements are subject to additional terms and conditions and payment of an additional fee. For more information, contact design@webnames.ca.

Promotion: Webnames.ca may in its discretion refer to the Customer Website, reproduce portions of the Customer Website, and provide links to the Customer Website as part of Webnames.ca's promotion, marketing and advertising of Kickstart and the Webnames.ca web builder Services.

Additional Assistance: Additional assistance, including the creation of additional website pages and assistance regarding further development and maintenance of the Customer Website, may be provided upon request as an Additional Service, at Webnames.ca's standard hourly rates and subject to additional terms and conditions. Webnames.ca is not obligated to provide any additional assistance to Customer regarding the design, development, creation or maintenance of the Customer Website.

Disclaimer: KICKSTART IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND WITHOUT ANY REPRESENTATIONS, WARRANTIES, CONDITIONS OR GUARANTEES OF ANY NATURE OR KIND WHATSOEVER. Webnames.ca does not represent, warrant or guarantee that Kickstart will meet Customer's needs or that the Customer Website created through Kickstart will be completed or function to Customer's satisfaction.
